The corrupt will not be able to leave before prison without returning the money

The Justice Commission of Congress today approved the reform of the Criminal Code that denies conditional freedom to those convicted of corruption who do not return the money and will punish with a fine the illegal donations to matches up to 500,000 euros, and with jail sentences superiors. One year and four months after its approval by the Government, the Commission has ruled today, with the rejection en bloc of the opposition, the flagship project of the Ministry of Justice for this term, which will be approved next week in the extraordinary plenary session of the day 21
In the voting of the more than 900 amendments, of which a third have been accepted or transacted, the popular ones have defended the reviewable permanent prison and have maintained at 16 years the age of sexual consent that included the original reform, although the PP does not rule out that you can lower to 15 in the processing in the Senate, as suggested by the other groups.
The package of anti-corruption measures has also gone ahead, including the requirement that those convicted of these crimes return the stolen money to the public coffers in order to have access to conditional freedom.
The popular deputy Leopoldo Barreda has explained the amendment by which those convicted of crimes against the public administration “must fulfill their pecuniary responsibilities and repair the damage caused before accessing probation,” that is, the prison supervision judge will not grant parole if the convicted person does not return the stolen money.
In addition, the text introduces the crime of illegal financing of parties for people who give or receive illegal donations. The amounts below 500,000 euros will be punished with a penalty and those that exceed it will be a crime.
The opposition has considered this threshold too low to argue that most donations do not reach such a high amount and therefore will not be punished by imprisonment but fines donations of less than 500,000 euros.
The socialist Manuel de la Rocha has lamented that the PP does not address changes in tax crimes, which are “present” in Spanish life as shown, has cited the case of the Infanta Cristina and her husband, Iñaki Urdangarin, or the extesorero of the PP Luis Bárcenas, reason why it has proposed to lower the type of 120,000 to 50,000 Euros to consider it fiscal crime, which has been rejected.
The text also maintains the figure of the crime of coercion to strike that the opposition has asked to repeal, although non-custodial sentences are included – mults – and the rates are reduced both for employers and for pickets, who will have more penalties higher than the first. However, the novelty is that the judge will not be able to apply both punishments at the same time, that is, he will be inclined to impose a prison sentence or a fine.
On the other hand, the new Penal Code will punish for the first time in Spain “sexual exploitation” against animals (zoophilia) with a penalty of three months to one year in prison, as well as animal abuse in shows that are not legally authorized, such as fights of roosters and dogs, with jail of six months to two years.
The majority of the parliamentary groups have celebrated – at the request of an agreement between PP and ERC – the introduction of penalties that will increase the protection of animals in the Spanish legal system, which will also punish abandonment when the life of the animal is at risk and It will disable the abusers from one to three years to have pets.
On the other hand, the opposition has denounced the “outrage” in the processing of the text by introducing important modifications not subject to the reports of the State’s advisory bodies, although the PP has explained that the changes deal with facts to the recommendations made by those organs, parties and various areas of civil society.
This has not been understood by the deputy Gaspar Llamazares of the Plural Left who has disengaged himself from the vote as a sign of “disobedience” before the express processing of the articles, which will be approved next week by the House Plenary.
